Booking Terms and Conditions
The following terms & conditions apply to all bookings (reservations) made via Devon & Dorset Holiday Cottages(also referred to as DDHC) for a holiday property rental and are deemed to be accepted by all parties at the point a reservation is made, whether the reservation is made online, by post or by telephone.
Definitions
A “booking” means a reservation of a holiday rental property
The “booking fee” is an administrative charge made by DDHC for processing the booking.
The “holidaymaker” means the person making the booking.
The “property owner” means the owner of the holiday property
Terms and Conditions:
The booking contract is an agreement between the holidaymaker and property owner. DDHC act as an agent for the owner/s and the property.
All bookings administrated via this site are done so under the following booking conditions. DDHC are responsible for the administration of this booking and do not own any of the properties and are not principals in the matter.
The booking contract is activated once the full deposit and booking fee has been received by DDHC and confirmation sent by DDHC to the Holidaymaker.
The booking contract is not transferable between properties.
The Holidaymaker must be over 18 years of age and agrees to be responsible for the party occupying the property and is authorised to agree to all the booking conditions of hire on behalf of all members of the party.
Upon booking the Holidaymaker confirms the property is suitable for their stay and that of any other party member.
The Holidaymaker must be one of the party members staying in the property
DDHC reserve the right to refuse bookings from all male or female parties of more than three people unless by special arrangement
All bookings are accepted on the clear understanding that the property is taken for holiday purposes only and is not used for any other purposes and must be vacated by the agreed time and date.
Occupation of the property will be from the check-in time on your travel detail information. Failure to depart on-time without prior agreement will result in additional charges.
The number of people occupying the property must not exceed the number shown on the confirmation or that advertised as the maximum on the website.
A deposit of 35% of the property rental and the booking fee must be received to confirm any booking.
Upon confirming a property with a deposit, the Holidaymaker is agreeing to pay the full balance no later than 60 days prior to arrival date
The deposit and booking fee and non-refundable
Properties cannot be transferred once confirmed with a deposit.
Where the final payment remains unpaid after seven days of the due date, DDHC has the right to cancel the booking and re-let the week. The Holidaymaker has no right to claim against either DDHC or the property owner for cancelling in the circumstance of late payment with no agreement or notification
All payments must be made in pounds sterling.
It is the responsibility of the Holidaymaker to immediately advise DDHC or the property owner of any damage or breakages which occur during their stay
All holidaymakers making a booking must provide valid credit/debit card details for a holding security deposit, no matter how they pay their deposit or final payment. These may be used by DDHC on behalf of the property owner to settle the cost of any damage for which the holidaymaker can reasonably be held responsible. Failure to provide valid credit/debit card details no later than seven days after the due date for final payment of the rental charge may result in the booking being cancelled.
Upon each departure the property will be checked by either DDHC, the Owner of a representative. Any unreported damage or breakages will be reported to the Holidaymaker with supporting information where appropriate. Any applicable costs will be agreed to be paid by the Holidaymaker
It is agreed that the Holidaymaker will vacate the property and leave in a tidy condition on departure. Failure to do so will lead to charges made for additional cleaning.
The Holidaymaker must submit any requests to amend their booking in writing to DDHC at the earliest opportunity.
DDHC will endeavour to facilitate any requests and liaise with the property owner as required.
The response of DDHC to any request for a booking amendment is final and the ability to not comply will not result in the booking agreement being cancelled unless then requested by the Holidaymaker and then under the conditions of cancellation.
The Holidaymaker must submit any requests to cancel their booking in writing to DDHC at the earliest opportunity
Upon confirming their booking with a deposit payment, the Holidaymaker accepts they are liable for the full amount of the holiday even if they cancel prior to the date set for payment of the balance
If the dates booked are resold The Holidaymaker can claim for a refund less the booking fee and a £50 + Vat admin charge from DDHC
DDHC and/or the Owner reserves the right to refuse any booking and/or to cancel any booking already made if the property becomes unavailable due to circumstances beyond its reasonable control such as, but not limited to, a fire or flood. In such an event, a full refund or, if acceptable, alternative accommodation will be offered to the holidaymaker. Neither DDHC nor the property owner can be held liable for any loss arising from the cancellation.
DDHC and/or the Owner have the right to cancel a booking should the holidaymaker not comply with these Booking Conditions. No refund will be due to the holidaymaker in such an instance
It is recommended that the Holidaymaker ensures they have adequate holiday insurance cover. DDHC will assist with any claim made on this by the Holidaymaker is required.
The Owner is responsible for providing holiday accommodation in a clean and tidy condition taking all reasonable steps to ensure that all facilities advertised are provided.
The Holidaymaker must ensure that the property is left in a clean and tidy condition failure to do so will result in an additional charge.
The Holidaymaker is responsible for the replacement of any article broken or damaged during their occupation of the property and for the repair of any damage done to the property itself excessive to fairly considered ‘wear and tear’
The Holidaymaker is responsible to ensure all party members show due care and respect to the property neighbours at all times
The Holidaymaker is responsible to ensure the party staying in the property does not exceed the capacity advertised or advised when booking. DDHC reserve the right to refuse entry should the party exceed the capacity
The Holidaymaker is responsible to ensure the property is used for its intended purpose. DDHC and the owner reserve the right to ask the party to vacate the property immediately should this be the case
Any vehicles parked at the holiday property or left at the property are done so entirely at the risk of the owner of the vehicle
All properties are non-smoking
Charging of electric vehicles is only permitted by prior consent or where advertised with the property, to do so without agreement will result in additional charges
The Holidaymaker agrees to allow access to DDHC and/or the Owner if deemed an emergency or if any of these conditions are not adhered to
The Holidaymaker is responsible to use the provided refuse system when staying in the property as detailed in the property information provided
The Holidaymaker is responsible for the property keys provided for their stay. A charge will be applied to replace if these are lost.
DDHC confirm that the detailed description of the property on its website or in its other marketing materials were accurate and up to date at the time of publishing.
Should DDHC become aware of any changes to the property that will materially impact the property description as advertised, DDHC will promptly inform the holidaymaker. DDHC will liaise between owner and Holidaymaker should any such change(s) result in the Holidaymaker wishing to cancel their booking without penalty. DDHC decision on the matter will be final
DDHC or the Owner cannot be held responsible for any changes or closures to local amenities or attractions mentioned in any of its marketing materials.
DDHC and/or the Owner have the right to amend these conditions or the pricing of the property at any time prior to the booking being confirmed
Neither DDHC nor the property owner is responsible for services to the property but will apply best endeavours to remedy as quickly as possible
Neither DDHC or the property owner are responsible for speed or coverage of Wi-Fi/Internet
The Holidaymaker will ensure that the supplied Wi-Fi/internet is not used for any unlawful or inappropriate purpose
DDHC or the property Owner accept no responsibility for any items left on the property once vacated. Should any items be found DDHC or the Owner will advise the Holidaymaker and endeavour to return if requested. Should the Holidaymaker report an item has been lost or left behind DDHC or the Owner will arrange to check the property at the soonest convenient time which may be on the next changeover day should the property be occupied.
Pets are only allowed in properties that are advertised as allowing them on the DDHC website
Where a fee is charged for pets, this must be paid prior to the holidaymaker’s arrival.
Holidaymakers’ assistance dogs are free of charge, but they must still be notified to OHC in advance.
Pets must be house-trained, clean and up to date with all their appropriate vaccines and flea prevention treatments.
Pets may not be left unattended in the property.
Pets are not allowed on any furniture or in bedrooms.
Where the property does not accept pets, this does not guarantee that pets have never been in the property.
The holidaymaker must remove all evidence of pet occupation, both inside and outside the property, before departing.
Any complaint must be received in writing addressed to DDHC prior to vacation of the property. It will not be possible to address a complaint after departure if not previously advised
DDHC will provide best endeavours to respond to any complaint or issues quickly but must be allowed a reasonable opportunity to do so without restrictions on access the property and if waiting for a response from the property owner or any other related person to the complaint made
These booking conditions and any claim or dispute arising in connection with their subject matter shall be governed by and construed in accordance with the law of England & Wales.
